At its meeting on November 4, 1996, the Academic Senate approved the following Sense-of-the-Senate Resolution presented by Ken Nuger and James Brent from the floor.

 

SENSE OF THE SENATE RESOLUTION

FREE SPEECH AND POLITICAL PARTICIPATION
AT SAN JOSE STATE UNIVERSITY

WHEREAS Members of the San Jose State University community (students, staff, faculty, administrators) should be encouraged to participate in the political process, and
WHEREAS a robust, vigorous, civil discussion of issues and candidates is important and essential in this political process, and
WHEREAS the U.S. Constitution and judicial opinions permit restrictions of speech, particularly political speech, even when some find it insensitive or wrong, only when there is a compelling reason, and
WHEREAS the recent removal of political posters from public view reveals a lack of knowledge about the law regarding free speech as well as understanding of the democratic political process, therefore be it
RESOLVED that the Board of Academic Freedom and Professional Responsibility consider the adoption of guidelines which would clarify the rights and responsibilities of free speech and political participation on campus and report to Professional Standards no later than its first Spring meeting.
